The Helthie Crusher Loyalty Rewards Program (the “Program”) is our way of saying thank you to our valued customers for choosing to nourish their bodies with our wholesome offerings. Whether you visit us for the helthie bar experience  or shop online, your loyalty is celebrated with every sip.

Enjoy your reward just for being a part of our Helthie community.

Participation and Acceptance

By accessing or using Helthie Crusher Loyalty Rewards Program you agree to be bound by all the terms and conditions set forth herein or incorporated by reference. These provisions govern participation in the Program and it is the member’s responsibility to read and understand all of them. 

Helthie Crush may change the program rules, conditions, benefits, or awards pertaining to the Program at any time without notice. Any changes or modifications will be effective immediately upon posting the changes to our website located at helthiecrush.com and our mobile and smart applications (the “Website”). You waive any right to receive specific notice of such changes or modifications. If you do not agree to all the terms, do not participate in this program.

Eligibility

Participation in the loyalty rewards program is voluntary and subject to specific program terms and conditions. By participating, you agree to the terms and conditions outlined in this policy.

• The Program is open to individuals aged 18 or have the legal capacity to enter into this agreement. 
• Online customers with a registered profile
• Helthie bar experience customer with a printed Customer Loyalty Card
• Individuals are only eligible to have one Helthie Crusher Loyalty Reward Program membership. 
• Memberships cannot be shared of combined by more than one person. 
• Corporations, associations, or groups cannot enrol in the Helthie Crusher Loyalty Rewards Program. 
• Helthie Crush reserves the right in its sole discretion to accept or deny any request to participate in the Program.

Earning Rewards

• Each eligible purchase of a Helthie Crush product earns 1 stamp/point (limit: 1 stamp/point per transaction). 
• Eligible purchases includes any product of the Smoothie Meals, Helthie Juices, Fruit Blends and Refreshers (Superfood Shakes and Smoothie Bowls are excluded). 
• After your 12th eligible purchase, your 13th purchase of a 12oz product is FREE.

Redeeming Rewards

• Your reward of a 12oz product is redeemable on your 13th purchase and applies only to Smoothie Meals, Fruit Blends and Refreshers. 
• Redemption excludes Superfood Shakes, Helthie Juices and Smoothie Bowls. 
• Reward must be redeemed in a single transaction and cannot be combined with other offers or discounts.

Tracking Your Progress

• Online Customers: points are automatically recorded in your digital account.
• Helthie Bar Experience: stamps are affixed to your Customer Loyalty Card

Non-Transferable & Expiration

• Online Customer: Rewards are non-transferable and linked to your personal account. Points do not expire, but inactive accounts (no purchases for 6 months) may be deactivated. 
• Helthie Bar Experience Customer: protect your Customer Loyalty Card. Lost cards are lost opportunity.
• Reward stamp/points have no cash value, cannot be converted to cash and are non-transferable.
• Accounts must remain active, with a valid email address and in good standing to qualify for reward points.
• All determinations regarding the standing or eligibility of an account shall be made at the sole discretion of Helthie Crush. 
• Online Customer: The update of reward stamp points may be delayed and can take up to 48 hours for reward points to post to your account.
• Online customer may proactively deactivate their account. 
• If Online Customer opts out of receiving reward program emails, the Member’s account will no longer be active and all reward points will be forfeited sixty (60) days after the account ceases to be active. 
• If a former Online Customer wishes to be a member in the Program after the former member’s account becomes inactive, the former Online Customer must create a new Helthie Crusher Loyalty Rewards account.
• Accrued reward stamps do not constitute property of the customer.

Abuse or Termination of Memebership

Helthie Crush reserves the right to:

• Suspend or terminate accounts that show signs of misuse, fraud, or abuse. 
• Discontinued membership under this Section will result in the immediate loss of all accumulated Program stamps/points and the Helthie Crusher Loyalty Rewards account will be closed. 
• Helthie Crush also reserves the right to deny future membership if Helthie Crush deems your conduct to violate these Terms and Conditions. 
• Our failure to insist upon or enforce your strict compliance with these Terms and Conditions will not constitute a waiver of any of our rights.

Termination of the Program

• Helthie Crush may modify or discontinue the program at any time, with reasonable notice.
• All Rewards points / stamp in any member’s account will be forfeited sixty (60) days after the written notification.

Right to Change the Terms and Conditions and Severability. 

• Helthie Crush may, at its discretion, change these Terms and Conditions of the Program. 
• If any provision of or change to these Terms and Conditions is found invalid, void, or for any reason unenforceable, that provision or change is severable and does not impact the validity and enforceability of any remaining changes or conditions. 

YOUR CONTINUED MEMBERSHIP AFTER ANY CHANGE TO THESE TERMS AND CONDITIONS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.

No Warranty. 

• The program is provided “As Is,” “As Available,” and without any warranty of any kind. 
• Helthie Crush does not guarantee the quality, completeness, timeliness, or availability of the Program. 
• Helthie Crush does not warrant that the Program will be uninterrupted or error free, that any defects in the Program will be corrected, or that the Program, the Website, or the servers, telephone networks or lines, computer online systems, or providers that make the Website available are free of viruses or other harmful conditions or components. Helthie Crush is not responsible for any typographical errors on the Website.

Limitation of Liability. 

• To the fullest extent permitted by law, Helthie Crush, its officers, directors, members, employees, agents or professional advisors (collectively, the ”Helthie Crush parties”) shall not be liable for any direct, indirect, special, incidental, exemplary, punitive, or consequential loss or damage, arising out of or in connection with the Program, or your access to or use of, or inability to access or use the Program, regardless of the form of action, whether the claim is based in contract, tort (including negligence), strict liability, warranty, or otherwise, and even if a Helthie Crush party has express knowledge of the possibility of the loss or damage. 
• Your sole and exclusive remedy is to stop accessing and using the Program.
• Without limiting the foregoing, in no event will the Helthie Crush parties’ aggregate liability to you arising out of or in connection with the Program, or your access to or use of, or inability to access or use, the Program exceed $1000 Jamaican dollars, even if any remedy provided fails of its essential purpose.

Dispute Resolution. 

• In consideration for participating in the Program, except for intellectual property claims, you agree that if you have a dispute with Helthie Crush about the Program, you will try to resolve the dispute through negotiation with Helthie Crush. 
• If agreement cannot be reached through negotiation, you agree to seek resolution on an individual basis only through binding arbitration in Jamaica and that the laws of Jamaica will govern the substantive resolution of the matter. 

Intellectual Property Rights. 

• All content and materials related to the Helthie Crusher Loyalty Program, including but not limited to text, images, videos, graphics, logos, trademarks, product names, icons, software, data, layout, and design elements are the exclusive property of Helthie Crush and are protected by copyright, trademark, and other applicable intellectual property laws.
• You may not use, reproduce, distribute, modify, or create derivative works of any part of the Program’s content without prior written consent from Helthie Crush. Unauthorized use of our intellectual property or that of any third party referenced in the Program may result in legal action. 
• Any third-party trademarks, content, or references used within the Program remain the property of their respective owners. 
• Unless clearly stated otherwise, no rights or licenses, express or implied, are granted to you under any Helthie Crush intellectual property.

Interpretation

• These Terms and Conditions, along with the Helthie Crush Privacy Policy, constitute the entire agreement between you and Helthie Crush regarding your enrollment and participation in the Program. 
• Any failure by Helthie Crush to enforce a provision of these Terms shall not be considered a waiver of that provision or any other rights. 
• A waiver is only valid if it is in writing and signed by an authorized representative of Helthie Crush. 
• Headings used in these Terms are for convenience only and do not affect their interpretation. 

Assignment

• Helthie Crush reserves the right to assign its rights and delegate its obligations under these Terms and Conditions at any time, without notice to you. 
• You may not transfer or assign your rights or obligations under these Terms to any other party.

Electronic Communications

To the extent permitted by law, all communications related to the Program—including these Terms and Conditions, notices, disclosures, and other program-related information—may be provided to you electronically via email, SMS, or through the Helthie Crush website or mobile application.

Privacy

By participating, you agree to our Privacy Policy. We only use your data to according to the Helthie Crush Privacy Policy, available at helthiecrush.com to track purchases, manage rewards, and deliver personalized offers.
